Where the Rule Comes From
The International Residential Code, section R310, requires an emergency escape and rescue opening in basement sleeping rooms. Virginia adopts the IRC statewide, and Fairfax County enforces it — the county may add its own amendments, so we build to the IRC minimums and confirm local details before we cut. Below are the IRC minimums, the numbers every window we install meets or beats.
The Five Numbers That Matter
1. Clear opening: 5.7 square feet. The open window must give you at least 5.7 square feet of clear space to climb through. If the window sill sits no more than 44 inches above the outside ground (a grade-level window), the minimum drops to 5.0 square feet.
2. Width: 20 inches minimum. The clear opening must be at least 20 inches wide — measured with the window fully open, not the frame size.
3. Height: 24 inches minimum. The clear opening must be at least 24 inches tall, again measured open, not the frame.
4. Sill height: 44 inches maximum. The bottom of the opening (the sill) can be no more than 44 inches above the bedroom floor. Higher than that, and a child or an older adult cannot get out.
5. The window must open from inside without keys or tools. Security bars or grilles are allowed only if they release from the inside with no key, no tool, and no special knowledge — and the opening still meets the size minimums.
The Window Well Rules
The well outside the window has its own minimums: at least 9 square feet of horizontal area, projecting at least 36 inches out from the foundation wall. If the well is deeper than 44 inches, it needs a permanently attached ladder or steps. A code-sized window opening into a well you cannot climb out of fails the whole point.
What This Means for Your Basement
Measure your current basement windows against those five numbers. Almost every original basement window in a Fairfax County home fails at least two of them — usually the opening size and the sill height. That is normal; those windows were built for light, not escape. Bringing the room up to code means cutting a bigger opening, setting a window that meets the minimums, and building a proper well.
